Lucon, Inc. Custom Heavy Haul Trailer Warranty
Structural Coverage
Lucon, Inc. expressly warrants to you, the original purchaser of a Lucon, Inc. Custom Heavy Haul trailer, that on the date of purchase by you, the product was free from defects in the composition of material and workmanship. This warranty covers the main trailer structure, consisting of the mainframe, and integral frame structures of Lucon, Inc. Custom Heavy Haul trailer. Replaceable or bolt-on structures are not covered under this warranty.
Warranty Duration and Notice Requirements
For Lucon, Inc. Custom Heavy Haul trailers this warranty shall remain in effect for the period noted below for structural defects after the date of sale to the original purchaser. This warranty shall not extend beyond that warranty period.
- 5 Year Structural Coverage
- 1 Year Coverage on all other parts manufactured by Lucon, Inc. and incorporated in the trailer, such as ramps, electrical components, front, side and roof components
- 90 Day Paint Coverage against peeling excluding staining due to rust seepage
Buyer shall give Lucon, Inc. prompt notice of all defects. Buyer should notify either an authorized Lucon, Inc. Dealer or Lucon, Inc. of any warranty problems. Upon receipt of such notice, Lucon, Inc. or the dealer shall promptly and without undue delay notify buyer of its intentions and preferences to effect repair of the trailer. Lucon, Inc. suggests that you take the trailer to the dealer where you purchased it, however, any authorized Lucon, Inc. dealer can work on your trailer.
Warranty Transfer
The basic warranty is non-transferable.
Remedies Available From Lucon, Inc.
In the event of a defect in material workmanship covered by this warranty, Lucon, Inc. at its sole discretion will:
Correct the defective work or replace the defective part on a no-charge basis.
Reimburse the original purchaser by paying a sum not exceeding the price charged to Lucon, Inc. for such work.
Lucon, Inc. may, at its option, require the defective part or trailer to be returned to the plant for repairs. All transportation charges in connection with a warranty claim will be the sole responsibility of the trailer owner.
Remedies Not Available From Lucon, Inc.
The obligations stated in the preceding paragraph are sole exclusive remedies available from Lucon, Inc., in the event a challenge to the warranty should occur. Lucon, Inc. will not be liable for any special, incidental, or consequential damages based upon breach of contract, negligence, strict liability in tort, or any other legal theory. Lucon, Inc. reserves the right to make changes in design or make additions and /or improvements to its product without being obligated to make similar installations or modifications to products covered by the warranty.
What Is Not Covered By This Warranty
Items not manufactured by Lucon, Inc. including, but not limited to, assembled axles, windows, coupler, jack, wheels, hinges, custom interiors, and trim. If and to the extent these items are warranted by the manufacturer or supplier thereof, Lucon, Inc. will extend such warranties to the purchaser.
Tires. Any claim on tires must be presented to the tire manufacturer’s representative.
Paint chipping and staining.
Normal wear items including, but not limited to, nylex, caulking, vinyl, paint, graphics, brakes, brake linings, bearings, hoses, etc.
Modifications, additions or accessories (not manufactured by Lucon, Inc.) added to the trailer after the trailer has shipped from a Lucon, Inc. manufacturing plant.
Damage or loss caused, in whole or part, by failure to check and torque lug nuts properly.
Damage or loss caused, in whole or part, by accident or negligence or by the abuse, misapplication or misuse of the trailer or any of its component parts.
Any transportation charge to or from factory or service center.
Damage or loss caused, in whole or part, by prolonged exposure to salt air, road salt, animal excretions, acid rain, industrial fallout, or acts of God or nature that are uncontrollable.
Any consequential or incidental damages based upon breach of contract, negligence, strict liability in tort, or any other legal theory, incurred as a result of any defect, to including loss of time, inconvenience, loss of income or use of vehicle, or any fees incurred by purchaser relating to a warranty claim.
What Will Void This Warranty
Misuse, neglect, overloading, unauthorized repairs, alterations, or failure to provide normal maintenance shall void this warranty.
No Other Warranties
THIS AGREEMENT IS THE COMPLETE AND EXCLUSIVE AGREEMENT BETWEEN YOU AND LUCON, INC., CONCERNING THE ALLOCATION OF THE RISKS OF DAMAGE OR LOSS ARISING FROM COMPONENT DEFECTS. THIS WARRANTY IS EXPRESSLY MADE IN LIEU OF ANY AND ALL OTHER WARRANTIES EXPRESSED OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS, AND NO ONE IS AUTHORIZED TO TAKE ANY FURTHER ADDITIONAL WARRANTIES ON BEHALF OF LUCON, INC. THIS AGREEMENT ALLOCATED THE RISKS OF DAMAGE OR LOSS ARISING FROM PRODUCT DEFECTS BETWEEN LUCON, INC. AND PURCHASER, AND BOTH PARTIES RECOGNIZE THIS ALLOCATION.
